REFUND POLICY

MASTER ADVOCATES REFUND POLICY.

The terms “us”, “we”, “our” and “MARES” refer to Master Advocates – Real Estate Services Pty Ltd (ABN 59 169 821 407), and the terms “you” or “your” refer to customers of Master Advocates – Real Estate Services Pty Ltd.

Purpose

Our goal at MARES is to make your experience enjoyable. This policy is designed to ensure your satisfaction and understanding of our refund processes.
This policy sets out the conditions under which the refund of your payment(s) to us may be granted and defines how refunds will be administered by us. If you have any questions about the information below please contact us.

Full refunds

You will be entitled to a full refund of the fees outlined below in the following circumstances:

  • of our Purchase Fee (if already paid) where we are acting in our capacity as Buyer’s Advocate and the vendor defaults on settlement or otherwise if the sale cannot be completed due to the vendor being unable to settle and transfer the property and title;
  • of our Sales Fee if we are acting in our capacity as Vendor’s Advocate and the purchaser defaults on settlement or otherwise if the sale cannot be completed due to the purchaser being unable to settle and transfer the property and title;
  • of payments made to us if we do not provide our service to you with the due care and skill reasonably expected of a Real Estate Service; and
  • where, in our sole discretion, other special or exceptional circumstances warrant a full refund.

Partial refunds

You will be entitled to a partial refund of your payment to us where, in our sole discretion, other special or exceptional circumstances warrant a partial refund.

No refunds

Upon engaging us you may be required to pay an Engagement Fee. An Engagement Fee
represents a payment made to engage our services. You will not be entitled to a refund of your payment of any Engagement Fee.
You will also not be entitled to a refund of any monies commissioned or used for disbursements on your behalf such as, but not limited to, agency fees and marketing or advertising costs.

Currency

All monies paid to us or refunded by us will be in Australian dollars.

Overpayments

If you make an overpayment to us, the overpaid amount will be refunded to you.

Payment of refunds

Refunds will be processed within 28 days of us approving a request by you for a refund. Refunds will be payable to you in a manner solely at our discretion.

Limitation of Liability

To the extent permitted by law (including, without limitation the Australian Consumer Law), we shall have no liability to you beyond the value of our services provided to you. This provision does not affect your rights or remedies in relation to any Consumer Guarantee that may be applicable to our services.

Law and Jurisdiction

The provisions of this Refund Policy are governed by the laws of Victoria.
